NBU: Ukraine to implement new standards of financial monitoring

New international standards of financial monitoring will strengthen opposition  to financial crimes, including money laundering, director of the department for financial monitoring of the National Bank of Ukraine Lada Smakhtina said during a roundtable, ForUm correspondent reports.
According to her, the introduction of new FATF standards will also strengthen cooperation between banks and the NBU. “The new version of standards was approved in February of 2012 and is mandatory for all member countries, including Ukraine. Requirements were introduced to implement efficient mechanisms to combat terrorism financing and spread of weapons of mass destruction and to improve the methods of risk assessment in fight against money laundering, when banks work with clients. One of the positive things is a permissibility of operations on open accounts only after identification of a client (legal or physical person). In addition, companies with stock listing will have a simplified identification,” the financier said.
In addition, she said that it is stipulated to develop the transparency of transfers, to include the tax crimes in monitoring of money laundering and to strengthen the role of financial intelligence.
As for the direct cooperation with banks on issues of financial monitoring, Smakhtina said that the National Bank tries to discuss carefully all regulatory innovations with bank community.

A delegation, headed by the governor of the National Bank of Ukraine, went to Washington to clarify positions on the recent visit of the IMF mission, head of the regulatory policy and monitoring committee of the Independent Association of Ukrainian Banks Artur Zahorodnikov said in response to a question of ForUm correspondent.

According to the financier, the cooperation with the IMF is important to the whole domestic economy, and its strategic reforming. “Stable hryvnia exchange rate and high-quality liquidity of the banking system in 2013 testifies to the fact that monetary policy of the National Bank was correct last year. This policy continues enjoying support of the majority of commercial banks – as well as the efforts of the NBU in the dialogue with the IMF,” the banker said.

He noted that there was a progressive change in approaches, as well as harmonization of legislation with international standards in the Ukrainian financial system in 2012. “In 2013, the positive innovations continue. In addition, stability of hryvnia exchange rate is kept. The latter is very important for the country as a whole. Moreover, that already allowed us to avoid serious problems, similar to those faced by the once stable financial systems of Greece and Cyprus,” the expert said.

Prime Minister Mykola Azarov, speaking during the hour of questions to the government today in the Parliament, called on MPs to return to constructive actions. He recalled that in 2010, it was well-coordinated work of all branches of government, which helped the country in economic crisis.

“The success of the reforms largely depends on the coordinated work of all branches of government. Certainly, in 2010, it would be much more difficult to pull the country out of the economic abyss, into which it had fallen, if there was no coordinated work of the President, government and Parliament. Where there is no teamwork, there is no result. I appeal to all – do not confuse Parliament with barricades and public policy with the rally,” Azarov said.

In the same speech, Prime Minister stressed that the opposition is also partially guilty of the current situation in the country. He recalled how during the election campaign, the opposition threatened Ukrainians with default, economic collapse, rising prices and the collapse of the hryvnia, which caused a foreign exchange rush among the population.

“I want to ask these oracles, who are sitting now in this hall and try to incite fear – where are your prophecies? Who have benefited from them – common people or speculators? How many of you will be responsible for the damage done to people?” Azarov asked

“I believe that today’s speech of Azarov was positive. He presented a good analysis on all state issues. You can argue about anything, but you can not argue with the figures,” he told journalists on the sidelines, ForUm correspondent reports.

Yefremov: Opposition works for us

The opposition has provided the Cabinet of Ministers of Mykola Azarov with quiet work for at least six months, leader of the Party of Regions faction Oleksandr Yefremov said, ForUm correspondent reports.

“It turns out that the opposition works for us,” he noted.

Responding to a clarifying question whether there was agreement between the majority and the opposition regarding the submission of bill on non confidence in the Cabinet, Yefremov said: “Every day we are accused of that we have agreed with either the opposition or the Communists, but we have such a fate – to agree with everyone. So, naturally, we agree and we get a result”.

Member of the Party of Regions also commented on yesterday’s support of some of deputies from the Batkivshchyna faction for the bills of majority.

“These people are most likely to understand what MPs should do,” he said.

“I think people realize that eventually they will have to go to the constituency and to tell people what they do. You’re not going to tell that you watch over the rostrum or hang around in opposition,” Yefremov added.

Ambassador of the European Union to Ukraine Jan Tombinski expects changes in the agreement on visa regime simplification to come into force on July 1.
“Next month, the Council of Ministers of the European Union will take decision, and the changes in the agreement on simplified visa regime will come into force on July 1,” Tombinski noted.
However, he refused to talk about the possible timing of the introduction of a full visa-free regime for the citizens of Ukraine.

Lawyers not use all possibilities given by new CCP, Pshonka says

The Prosecutor General Viktor Pshonka said that lawyers do not fully use the possibilities, given by the new Code of Criminal Procedure.

Pshonka noted that with the adoption of the CPC, all hoped for more adversarial process. “Instead, defense, nearly a hundred thousand lawyers, does not actively use all procedural levers available to them,” Pshonka said at the all-Ukrainian meeting of the prosecutors.
According to him, it puzzles society as people incorrectly interpret the new Code of Criminal Procedure, considering it to be even more punitive.

Yanukovych: Adoption of new CCP becomes important step in Ukraine’s development

Adoption of new Code of Criminal Procedure became an important step in the development of Ukraine as a state of law, President of Ukraine Viktor Yanukovych stresses, ForUm learned from the President’s press service.
“This step confirms the desire of the Ukrainian society to break old patterns, introduce new regulations to modernize its law enforcement system and to change the standards of its activity,” he said, speaking at the all-Ukrainian meeting of the prosecutors on the implementation of the requirements of the new Code of Criminal Procedure and priorities for their further reform.
Yanukovych noted that the adoption of the new Code of Criminal Procedure was one of Ukraine’s commitments to the Council of Europe.
President is sure that the radical and systemic change, based on international experience and European standards, can make the transition from the prosecution to the adversarial model of criminal justice.
