Tymoshenko’s defense team to appeal to European Court against gas case verdict

Former Prime Minister of Ukraine Yulia Tymoshenko’s defense team is seeking legal opportunity to lodge a complaint against the verdict in the gas supply case with the European Court of Human Rights (ECHR) without cassation in Ukraine.

“We are now looking for an opportunity to go to the European Court,” Tymoshenko’s defense counsel Serhiy Vlasenko told Interfax-Ukraine on Friday.

State Prosecutor Lilia Frolova doubts that the European Court of Human Rights will accept a complaint by Ukraine’s former Prime Minister Yulia Tymoshenko against the verdict in the gas supply case, until there is no ruling of a court of cassation.

“As far as I know, one needs to go through courts of all instances in the state (before one can file a complaint with the ECHR). This will be up to the European Court whether to take the case for consideration,” the prosecutor told reporters on Friday after the Kyiv Court of Appeals upheld the sentence imposed by the Kyiv Pechersky Court on Tymoshenko, who has been sentenced to seven years in prison for exceeding her powers when signing the gas supply contracts with Russia in 2009.

Under the law, the cassation against the decision of the Court of Appeal in this case should be filed to the Supreme Specialized Court in charge of civil and criminal cases.

Kyiv authorities ordered conservation of foundation of the Church of the Dime

Today, December 23, in accordance with the order of the Kyiv city state administration signed by Kyiv mayor Oleksandr Popov, enterprise “Directorate of restoration works” starts conservation of the remaining foundation of the Church of the Dime on the territory of national archeological monument.

According to director of the enterprise Genandy Gera, the works will be conducted under supervision and control of scientists. The works are planned to be finished by December 31. Total 460 vehicles with sand and special ground will be used to preserve the remains of the unique archeological finding. It is planned to build the so-called clay castle, which will prevent moisture from getting to the foundation and its further destruction. Temporary conservation of the monument aimed at protection from unfavourable weather conditions.

As a reminder, members of an archeological expedition noted that taking into account the condition of the foundation of the Church the authorities must take urgent measures to save the historical shrine.

Naftogaz may lease out underground gas storages

NJSC Naftogaz of Ukraine is studying the possibility of leasing out its underground gas storages to the companies that will produce gas in Ukraine, Naftogaz deputy chairman Vadym Chuprun said.

“The matter concerns possible lease of underground gas storages in the future for further supplies of gas, including shale gas extracted in Ukraine, to the European consumers. After all, they will have to store it somewhere. And we will give them that opportunity,” Chuprun emphasized, UKRINFORM reports.

He said that the company is in talks with ExxonMobil over the use of Ukrainian gas storage facilities.
The Naftogaz deputy head said the state holding has intensified cooperation with leading foreign companies – ExxonMobil, Chevron, Halliburton, Total, RWE, Eni and StatOil in the production of unconventional hydrocarbons.

He stressed that the year 2011 was a breakthrough for Ukraine to explore shale gas – a number of companies signed agreements of confidentiality and cooperation, as well as areas of interest.

Ukraine operates 13 underground gas storages (UGS) with total active capacity of more than 31 billion cubic meters. 12 gas storages and gas pipeline system are run by Ukrtransgaz, another gas storage – SJSC Chornomornaftogaz (AR Crimea), 100% owned by NJSC Naftogaz of Ukraine.

Ukraine, EU agreed FTA part of Association agreement

As a result of the agreements reached at the Ukraine-EU summit, technical validation of the draft Association Agreement between Ukraine and the European Union in terms of establishment of a deep and comprehensive free trade area was completed in Brussels on December 22, Vice PM and Economy Minister of Ukraine Andriy Kliuyev said in an interview with journalists.

According to him, the corresponding protocol was signed by heads of delegations – Government’s Commissioner for European Integration of Ukraine Valeriy Piatnytsky and Director of the Directorate General for Trade at the European Commission Rupert Schlegelmilch.

Andriy Klyuyev said that now the parties may proceed to the internal procedures necessary for initialing of the Agreement. “The work is in progress,” the official summed up.

Tymoshenko’s sentence comes into force today

Representative of the state prosecution, prosecutor Lilia Frolova told a press conference that from today the sentence of Yulia Tymoshenko on gas case comes into force.

“The decision has been announced. The Court of Appeals has five days to work out the decision in written form. From today the sentence comes into force,” Frolova said.

According to the prosecutor, the state prosecution team was present during the announcement of the decision. “We managed to get in time,” she added.

Frolova also declared that the state prosecution is satisfied with the decision of the Court of Appeals. “We did challenge the decision. We considered it legal and grounded, and today we have proved it in court,” she underlined.

The prosecutor also informed that on December 29 at 4 pm the chamber of the Court of Appeals will announce the decision in full.

As a reminder, the chamber of Kyiv Court of Appeals has left unchanged the sentence of Yulia Tymoshenko, pronounced October 11 by Pechersk District Court of Kyiv on gas case. The corresponding decision was announced by presiding judge Olena Sytailo after 50-minute meeting in the decision room.

“The sentence by Pechersk District court to leave unchanged. The full text of the decision to announce December 29 at 4 pm,” judge Sytailo pronounced.

The chamber of Kyiv Court of Appeals has left unchanged the sentence of Yulia Tymoshenko, pronounced October 11 by Pechersk District Court of Kyiv on gas case. The corresponding decision was announced by presiding judge Olena Sytailo after 50-minute meeting in the decision room.

“The sentence by Pechersk District court to leave unchanged. The full text of the decision to announce December 29 at 4 pm,” judge Sytailo pronounced.

Most probably the court decision was announced in absence of the state prosecution, as prosecutor Lilia Frolova told journalists the prosecution team would leave the judges to decision and would come back to the courtroom at 2 pm. However, the court announced its decision at 1:20 pm.

Yefremov: Abolition of MP’ privileges allows saving millions of hryvnias for the state budget

State budget savings from abolition of MPs benefits will be millions of hryvnias, MP of Ukraine, Chairman of the Party of Regions parliamentary faction Olexander Yefremov told a briefing in the parliament on Thursday, ForUm learned from the press office of the Party of Regions.

“Yesterday, when approving the budget, as we promised, we voted for decision to abolish benefits for people’s deputies. We did not count the ultimate amount of savings due to the benefits’ cancellation. I can only say that savings by one of the articles are more than 50 million, and by the other – more than 20 million,” the MP said.

According to Olexander Yefremov, MPs deliberately decided to abolish the benefits.

Commenting on the work of parliament for the year, the MP stated that “practically all tasks set by the parliament were fulfilled.”

“We’ve managed to work more or less constructively in the parliament,” the politician summed up.

PM Azarov: Revolution limit already exhausted in Ukraine

Prime Minister Mykola Azarov said that he strongly opposes any revolutions, the head of government was speaking in an interview with Larry King, the renowned American broadcaster and journalist, according to UKRINFORM.

“Probably, Ukraine has already exhausted its limit on revolutions. We have recently had a revolution – 7 years ago. People felt what it was like. Some politicians in Ukraine really want revolutions, but I am a strong opponent of revolutions,” Azarov emphasized.

According to the prime minister, in 2004 Ukraine was one of the most successful countries in Europe with a GDP growth of more than 15% and an extreme pace of export growth. “Just imagine 10 years of such development – and now Ukraine could be totally different. And then, in late 2004 we saw the so-called Orange Revolution – we were taken away for five years,” Azarov said.

A reminder that in November Larry King in Kyiv recorded an interview with Mykola Azarov at the First National television channel.
