Decriminalization of economic crimes to bring money to state treasury – official

Decriminalization of economic crimes will promote the introduction of European standards in the sphere of criminal justice, President’s representative in the parliament Yuri Myroshnychenko said, commenting on the presidential draft bill on decriminalization of economic crimes, submitted to the parliament.

Myroshnychenko noted that successful experience of European countries proves effectiveness of the decriminalization of economic crimes, ForUm learned from the presidential press office.

“If punishment gets replaced with fine exceeding caused damage, it would be a good lesson for offender and the state will get compensation,” he explained.

Myroshnychenko also noted that the amendments to the Criminal Code provides for abolishment of 18 articles in order to prevent corruption in the law enforcement bodies. The draft bill also proposes to limit detention measure replacing it with bail.

Sociologists: Higher price of cigarettes won’t reduce number of smokers

The increase in excise duties in the fight against tobacco is ineffective, say sociologists with the Bureau of Statistical Analysis, based on the findings of a large-scale survey conducted in the largest cities of Ukraine.

Almost 40% of Ukrainian smokers say they will still buy cigarettes of favorite brands, even if tobacco products become more expensive and after the rise in excise duty rates. Moreover, 75% of Ukrainian smokers believe that the increase in excise duty on tobacco products will boost sales of illegal cigarettes. Meanwhile, the poll also found that 20% of smokers say openly that they will look for cheaper cigarettes, UKRINFORM reported.

Market expert Volodymyr Demchak explains that, really, in case of increased excise taxes, cheap counterfeit would be in great demand among tobacco smokers, which will certainly lead to a shadowing of the market of tobacco products. Now, about 15% of the market of tobacco products – it is dangerous to health illegal products from Moldova and Russia, which, by the way, are not taxed.

A ban on tobacco advertising is not an effective measure to combat smoking as well. Sociologist Maria Chernova says that the majority of urban respondents increasingly face information about smoking hazards, but not the promotion of tobacco brands. However, a consumer lacks information about the quality of cigarettes. At the same time 61% of urban residents believe that information on cigarettes (labeling, warning labels, etc.) does not affect the person’s desire to quit or start smoking. Because the main cause of smoking, according to those surveyed, is the influence of friends and the desire to look older.

FM: Visa free regime with EU possible in 2-3 years

Foreign Minister of Urkaine Kostiantyn Hryshchenko forecasts that Ukraine may get visa free travel with EU countries in two-three years.

“If the dynamics of the dialogue continues and requirements for visa free travel don’t change we can obtain visa free regime in two-three years,” he said in an interview with Ukrainska pravda.

He also underlined that we should remember about politically emotional constituent of the question.
According to him, a number of European countries are against simplification of visa regime in general. “It’s made not only out of rationalism, but rather due to phobia of electorate of inflow of immigrants,” the minister added.

Defense ask court to acquit Tymoshenko due to lack of evidence

Defense attorney Yuriy Sukhov has asked the court to acquit Yulia Tymoshenko and release her from jail.

“Yulia Tymoshenko’s actions did not constitute a criminal offense, and so there must be an acquittal in this case. Given all that I have presented, I ask the court to acquit Yulia Tymoshenko and release her from custody,” Yuriy Sukhov said in court today.

The lawyer said that the prosecution did not clearly formulate the nature of the charges, element and event of crime. Moreover, there are confusions and gaps in time in the indictment.

Yuriy Sukhov added that the indictment doesn’t clearly define the time of the “abuse of authority” and “abuse of official powers” and does not establish a causal connection between the directives issued by the ex-premier for talks between Naftohaz and Gazprom and the signing of the contracts.

Student, who hit Tabachnyk with bouquet, leaving university

Student of the national university “Kyiv-Mohylianska academy” Daria Stepanenko, who hit education minister Dmytro tabachnyk with flower bouquet, intends to break the contract with the university.

According to the press office of “Brotherhood of Saint Lukas”, member of which is Daria, the reason of breaking the contract is alleged disapproval of the student’s actions from the academy side. Four other students will join Stepanenko.

The statement of the Brotherhood says that on September 26 the students’ board with participation of university president Serhiy Kvit decided to deprive Stepnenko of university diploma, provided in accordance with corporate contract, and to give her a diploma of state model.

Later academy president Kvit declared the student would not be punished, but she and her followers decided not to accept “indulgent disapproval” and to break the contract.

“The university does not merit to diploma me, “Stepanenko stated.

Agrarian minister reveals details of free trade area agreement with EU

Minister of agrarian policy of Ukraine Mykola Prysiazhnyuk told a press conference that the talks on free trade area with EU are successful and the main positions have been already agreed between the sides, ForUm’s correspondent reports. The minister also revealed some details of the agreements.

“If to speak about concrete figures, I want to inform that Ukraine can sell tax free 1 million tons of wheat, 350 thousand tons of barley and 650 thousand tons of corn. As for meat sector, we can sell tax free 12 thousand tons of beef, 40 thousand tons of pork. Besides, Ukraine can sell 57 thousand tons of sugar and sugar syrup, which is very profitable for us, because we failed to reach agreement on sugar trade with Russia,” he said.

The minister also specified that Ukraine can export to Europe 3 thousand tons of eggs and products on its basis, 50 thousand tons of vegetables and 270 thousand tons of fruit. 

“Europe also allowed us to export tax free 100 thousand tons of bio-ethanol,” the official said. Prysiazhnyuk pointed out that such figures will stimulate bio-ethanol production in Ukraine. “100 thousand tons is 50% of spirit produced in Ukraine,” he said.

The minister paid special attention to the agreement, which prohibits the EU countries to subsidize their agriculture producers, if their production will be exported to Ukraine. Prysiazhnyuk added that subsidy assistance for European producers, who export goods to Ukraine, would mean unfair competitive conditions for Ukrainian and European consumers.

“Having banned subsidies the EU gives our production a possibility to compete at the European market,” the minister summed up.

Poland to increase number of consulates in Ukraine

Poland will open more consulates in Ukraine, official of Polish embassy in Ukraine Rafał Wolski told a press conference, ForUm’s correspondent reports.

He reminded that Poland has its consulates in Kyiv, Kharkiv, Lviv, Odesa, Vynnytsia and Sevastopol and informed it is planned to open several visa application centers, in particular in Ivano-Frankivsk, Dniepropetrovsk, Donetsk and Lviv.

Wolski noted that formation of such visa centers is aimed at simplification of visa application procedure. He also informed for the last eight months Poland has granted 381 thousand of Schengen visas. The level of visa denial is 2.6-7.7%

ForUm also learned that similar centers might be opened soon in Zhytomir, Ternopil, Rivne and Crimea.

NBU promises to improve currency exchange procedure

The head of the National Bank of Ukraine Serhiy Arbuzov informed that NBU officials are analyzing the situation on the market and discussing expediency of new rules for currency exchange procedure.

“We don’t exclude that within the time, when citizens get used to new rules, we will allow banks to perform currency exchange procedure of small amount without passport presentation,” Arbuzov said. At the same time he did not specify the amount of currency, which could be changed without passport.

NBU head assured that passport data of citizens is a banking secrecy and can be revealed to tax administration of monitoring service only by court order.

As for the rules of currency exchange for foreigners, nothing has changed, Arbuzov said. “They have a right only to sell currency and can buy it back while leaving the country. Free sell of currency to foreigners never existed in Ukraine,” he noted.

In response to the question what caused the change of rules for currency exchange procedure, NBU head explained that the practice of checking client’s residence exists since 1993 by the decree of the Cabinet of Ministers. However, banks did not follow the limits of currency exchange procedure.
According to Arbuzov it resulted in that “any inflation rumors or activity of shadow sector of economy were causing feverish demand of currency cash, which led to its withdrawal from the banking turnover.”

Secondly, NBU head noted, such practice exists in Italy, Hungary, Greece, China, Japan, Russia, Bulgaria and some other countries. Directives of FATF require the state to check that clients who perform exchange in large amount do not use this money on criminal purpose.
