Prosecution witness confirms links between Yushchenko and RosUkrEnergo

Former Naftohaz Chairman Oleh Dubyna said today in court that Ukraine bought natural gas from Russia through then intermediary company RosUkrEnergo with the participation of former President Viktor Yushchenko.

“Yes, I think that then this was a political decision made by Viktor Yushchenko. Let him tell you about it,” Oleh Dubyna said while testifying in court today, Tymoshenko’s official website reported.

In his opinion, it was this contract signed between RosUkrEnergo, Gazprom and Naftohaz that led to the removal of the linkage between the price Ukraine paid for gas and the cost of transit, made it impossible to change the tariff rates for the transport of natural gas across Ukrainian territory, and eliminated the possibility of Ukraine purchasing alternative natural gas from Uzbekistan or Turkmenistan. “This contracts had at least three evils,” he said.

The former head of Naftohaz also said that he met several times with RosUkrEnergo shareholders. “I met with them three times in Viktor Yushchenko’s office, twice in Baloha’s,” said Oleh Dubyna, thus confirming the existence of ties between the former head of state and RosUkrEnergo.

The witness also said that the purchase of 11 billion cubic meters of gas that at the time belonged to RosUkrenergo was demanded by the Russian side. “I was surprised that after the signing of this agreement the Russian side insisted that this was our initiative,” he added.

Oleh Dubyna also said that the signing of the gas contracts with Russia couldn’t be delayed given that the supply of Russian gas to Europe has stopped. “This had to be done urgently,” he said.

Oleh Dubyna also refused the prosecution’s claims that Naftohaz and Ukrtranshaz suffered losses as a result of the signing of the gas agreements in 2009. “2.6 billion – the consolidated profits of the company Naftohz,” he said.

President: It is crucial to elaborate miners’ work protection program

President Viktor Yanukovych considers it necessary to develop a program of protecting miners at work, he said during today’s meeting of the Government commission for investigating causes of the Sukhodilska-East coal mine blast.

According to Viktor Yanukovych, the program should be jointly elaborated by the specialized authorities, and managers and owners of mines. “We should work together to create a program that would provide for the absolute performance of all the measures necessary to protect miners at work,” the President of Ukraine said, referring the meeting. 

“I draw your attention to the importance of drawing objective conclusions from the tragedy. Most importantly – this must not happen again,” he said.

Donetsk (eastern Ukraine) will comply with the UEFA requirements for hosting the UEFA family during the European Football Championship in 2012, Deputy Prime Minister and Infrastructure Minister Borys Kolesnikov says.

According to him, the capital of Donbass is not a tourist center, so building high-star hotels in Donetsk is unprofitable. “Ukraine’s eastern mega cities should hold more competitions, business forums and exhibitions, which takes the creation of an appropriate infrastructure in Dnipropetrovsk, Kharkiv and Donetsk. Thus we can build up our hotel industry. The government is working over this,” Kolesnikov said, UKRINFORM reported.

Donetsk Mayor Oleksandr Lukianchenko says the city is ready to provide accommodation for the UEFA family during group matches and quarterfinals. “To ensure accommodation during the semifinal match, we are negotiating with airlines the provision of 15-20 Airbuses, which would take the guests from Kyiv, as we definitely do not have time to build high-level hotels by the EURO,” the Donetsk city head said.

Court refuses to consider Tymoshenko’s motions

Batkivshchyna Party leader and former Prime Minister Yulia Tymoshenko has entered a motion to admit Serhiy Vlasenko to the case as a representative of the civil defendant.

“Since you have not allowed Serhiy Vlasenko to serve as a public defender, I have one more opportunity to defend myself by admitting him to this case as a representative of the civil defendant, because there is a civil case against me by Naftohaz, making me the civil defendant. According to articles 51 and 52 of the CPC, I have the right to defend my rights as a civil defendant,” Yulia Tymoshenko said today in court.

Judge Rodion Kireyev rejected the request, saying that Serhiy Vlasenko had already participated in the case as a defense counsel.

Tymoshenko has also submitted to the office of the Pechersk District Court of Kyiv a number of other motions, including requests to disqualify Judge Kireyev, postpone the trial, admit a representative of the civil defendant to the case, add to the record some articles from online publications, etc.

The judge has refused to consider the motion to disqualify him, accusing Yulia Tymoshenko of trying to drag out the proceedings. The ex-premier responded by accusing the judge of violating her right to enter motions in court.

Explosion hit Luhansk mine killing 16 miners

A powerful explosion rocked the Sukhodilsk-Eastern mine in Ukraine’s eastern Luhansk region early Friday, killing 16 workers, and two workers were hospitalized with burns, while 10 remained missing, emergency officials said.

The blast hit the mine at about 2 a.m. local time Friday, July 29, at a depth of 915 meters (0.6 miles), the Emergencies Ministry said.  28 miners have been working in the mine at the time of the accident. As of 7 a.m., 16 miners are killed, 2 are hospitalized with burns and injured, and other 10 miners are missing.

President Viktor Yanukovych delivered his condolences to the families of those killed and has ordered the government to form a commission to investigate the cause of an explosion, president’s press office informed.

President Yanukovych also ordered to provide assistance to the families of the people killed and suffered after a deadly blast at the mine.

US Embassy Human Rights Attache Matt Stafford has arrived at the Pechersk District Court in Kyiv to following the trial of Yulia Tymoshenko after today’s break in the proceedings.

Hearings are taking place every day, and every day there are diplomats in the courtroom. Representatives of the French Embassy have been monitoring the proceedings regularly.

Speaking at a recent round table organized by the Ukrainian Law Society, French Ambassador Jacques Faure said that events surrounding the trial of Yulia Tymoshenko don’t promote a positive image of Ukraine abroad.

Ukraine may initiate creation of world grain reserve under UN auspices

Experts of the Agriculture Ministry and the National Academy of Agricultural Sciences are preparing a memo to the President on the initiative of creating a world fund of grain under the UN auspices. It is also proposed to establish a reserve stock of grain in Ukraine, President of the National Academy of Agrarian Sciences of Ukraine Mykola Bezuhly announced during a press conference at UKRINFORM.

“The deficit of grain in the world will be constant. Therefore, Ukraine can initiate the creation of the world’s grain reserve under the auspices of the United Nations. This fund will be owned by the Food and Agriculture Organization of the United Nations, FAO. The reserve should be funded by international financial institutions. Ukraine can also benefit from participation in the creation of the world grain reserve,” Bezuhly said.

The Academy President noted that, under the program Grain of Ukraine, within the coming six years Ukraine may reach annual grain production of 80 million tons. Of these, 35 million tons will be spent for domestic needs, and the rest for export. Ukraine’s grain reserve may be of 5-10 million tons.

Ombudsman Karpachova decides to distance herself from trial of Yulia Tymoshenko

Yulia Tymoshenko’s lawyer Serhiy Vlasenko says the office of the Verkhovna Rada Human Rights Commissioner has not responded to their request sent last week for Nina Karpachova to become an independent participant in the trial against the former Ukrainian prime minister.

“The fact that nobody from her office is coming here, at least under the appropriate authority, means that Karpachova has decided to distance herself from the trial and not participate, which seems logical to us,” Serhiy Vlasenko said before the start of today’s hearing, according to Tymoshenko’s official website.

He pointed out that Nina Karpachova was a top candidate for parliament from the Party of Regions. “Despite Karpachova’s attempt to maintain a neutral line, we remember that she’s a member of the top five of the Party of Regions and, judging by everything, she had to refuse to participate in this trial, although it’s obvious that the participation in this case of the Ombudsman or a representatives is essential,” he stressed.
