Parliament cancels obligatory notary certification of land rent agreements

The Ukrainian parliament has supported at second reading a bill “On amending several laws of Ukraine (regarding land relations)” liquidating obligatory notary certification of land rent agreements&#-2079;ccording to Kyiv Post.

The bill was supported by 233 MPs out of the 432 registered in parliament on Thursday.

The MPs decided to exclude Article 290 from the Economic Code of Ukraine. The article stipulated obligatory notary certification of land rent agreements.

Apart from that, the MPs cancelled an earlier provision of the Economy Code stipulating that the amount of rent fee for state- or municipally owned plots cannot be lower than the fee set by the law.

The Cabinet of Ministers has two weeks to harmonize its resolutions and other legal acts with the document.

The bill comes into force from the day of its original publication.

VRU requiring President to suspend Chernovetskyi

The Verkhovna Rada is requiring that President Viktor Yuschenko suspend Leonid Chernovetskyi from the discharge of his duties as head of Kyiv municipal state administration, Ukrainian News reported.

Draft bylaw No.4504 was voted by 228 parliamentary deputies, when 226 votes required.

In particular, 153 MPs of the Yulia Tymoshenko Bloc faction supported the bylaw, 1 of the Party of Regions, 27 of the Communist Party, and 47 of the Our Ukraine – People’s Self-Defense bloc faction.

Chernovetskyi is to be suspended while an ad hoc parliamentary investigatory commission is inquiring violation of the Constitution and of laws by Kyiv municipal council and Kyiv municipal administration officials.

Parliament extended the term for the commission to work into November 19.

By adopting the bylaw, the Rada also recommended Yuschenko to cancel Chernovetskyi’s law-breaking orders on appointment of first deputy heads of the municipal administration.

In its turn, parliament recommended that the Cabinet of Ministers convene an extraordinary session to discuss the critical situation in Kyiv, cancel Chernovetskyi’s law-breaking orders on appointment of administration the deputy heads.

Also the Rada recommended the government to prepare and bring in for consideration propositions on perfecting the legislation concerning organization of local self-government and executive power in the capital.

Moreover, parliament instructed the Counting Chamber, the Main Control and Audit Chamber and the State Tax Administration to jointly check the city hall for observance of budget and tax laws, and the Prosecutor-General’s Office and the Interior Affairs Ministry to provide legal assessment of the executives’ actions.

As a reminder, the Verkhovna Rada on June 5 refused to recommend President Viktor Yuschenko consider the possibility of dismissing Chernovetskyi by directing the commission draft a new bylaw.

Speaker of the Verkhovna Rada Volodymyr Lytvyn is expecting parliament to again deal with this recommendation to Yuschenko on June 9-12.

On February 19, the Rada set up the commission to inquire violation of the Constitution and of laws by Kyiv council and Kyiv administration officials.

Yushchenko insists on solution of Naftogaz problem

Ukrainian President Viktor Yuschenko has demanded that a program to solve the problems of National JSC Naftogaz Ukrainy should be drawn up within ten days, according to Interfax-Ukraine.

“A program for solving the problems of Naftogaz should be drafted within ten days,” he said at a meeting in Kyiv on Thursday on the financial condition of Naftogaz Ukrainy.

Yuschenko said that this should be a joint national plan involving the government, the parliament, the National Bank of Ukraine, the Prosecutor General’s Office and the State Tax Administration.

The president stressed that clear, bold and professional decisions are required to help Naftogaz Ukrainy overcome its financial crisis.

Yuschenko also said that the situation at Naftogaz Ukrainy threatens the national security of Ukraine.

PR insists on anticrisis program and changes to state budget

Making a speech in the Verkhovna Rada on Wednesday, Member of Parliament, the Party of Regions parliamentary faction Deputy Head, Minister of Industry and Enterprise of the Opposition government Anatoliy Kinakh marked:

– It is obvious that the Ukrainian people, economy, state are becoming hostages to ever greater extent of not only disgraceful confrontation among the authorities, their hazardous actions and irresponsibility. Today the state, in fact, is under a dirty roof of cynicism, lies, distortion of facts about the real social and economic situation in this state.

Ukraine is by far the only state on the European continent, which still does not have a ratified national anti-crisis program – the program of common actions of the government, National Bank and, where necessary, parliament. In fact, today we see once again how parliament’s lack of the submitted draft on alterations to the 2009 state budget, specification of the currency and monetary policy proves the authorities’ incompetence and irresponsibility. It is aggravating the crisis in this state.

In this light we are faced with unprecedented sharpening of legal nihilism, multilevel corruption and almost totally failed human resources policy, which pursues “ours-not ours” principle, a fierce fight for the posts or access to resource. It matters much today that the government forbade the publication of actual data of national social and economic growth. It practically leaves no possibility of drawing up a strategy of anti-crisis measures, as well as lowers steeply the level of trust to Ukraine of both investors and partners.

Ukraine is the only state on the European continent and among the CIS countries, which has not provided data on the dynamics of gross domestic product. The independent experts say its drop rate over 1Q 2009 was at least 21%. It is an unprecedented fall with no analogues in the world economies. We see the same situation with the information about the State Treasury Accounts. There is a direct prohibition of publishing data by the entities without the State Treasury’s concurrence…

This lie, this unprecedented cynicism should be stopped, otherwise we will see further sharp worsening and decline in the citizens’ living standard, impoverishment of all Ukrainian people. We demand a report by the Cabinet of Ministers of Ukraine at this session on real social and economic situation in the state premised on a rigid unpoliticized ground, as well as the immediate approval of the Anti-crisis program along with the alterations to the 2009 budget.

VRU overrides President’s veto of law banning gambling business

The Verkhovna Rada of Ukraine has overridden a President’s veto of the law banning the gambling business in Ukraine, the ForUm’s correspondent informs.

390 out of 429 MPs registered in the session hall voted to override the President’s veto, in particular 160 MPs from the Party of Regions faction, 152 MPs – BYuT faction, 32 MPs – Our Ukraine-People’s Self-Defense faction, 27 – Communist Party faction and 20 Lytvyn bloc.

PR continues negotiations with BYuT

The Party of Regions has not stopped negotiations process with the BYuT faction. MP from the Party of Regions Vadym Kolesnichenko said, the ForUm’s correspondent informs.

Kolesnichenko confirmed continuation of negotiations between the Party of Regions and BYuT on issues concerning changes introduction into the Constitution. He does not exclude further joint voting of two factions for urgent and key draft laws in the parliament.

Commenting on secret agreements between PR and BYuT, Kolesnichenko said that if to analyze the work of the VRU for last year then the majority of laws was adopted by 300 -400 MPs (with help of PR-ed.). “If it is a form of secret agreement – then yes, it is a secret agreement. Therein lies a work of the VRU – to consolidate MPs despite political flags for voting for necessary laws,” he added.

“Of course we do not vote for laws which do not coincide with our political program. These are ideological issues,” Kolesnichenko said. According to him, the very ideological inconsistency impeded the creation of coalition between BYuT and PR.

Ukraine and EBRD sign Memorandum of cooperation in energy domain

The Government of Ukraine and the European Bank for Reconstruction and Development have signed Memorandum of mutual understanding between Ukraine and the EBRD concerning measures to ensure sustainable development of energy sector, according to government portal.

From the Government of Ukraine the document was signed by Vice Prime Minister for European and International Integration Hryhoriy Nemyria, from the EBRD – EBRD Director for Ukraine André Küüsvek. The signing ceremony was held with participation of the Prime Minister of Ukraine Yulia Tymoshenko.

The Premier of Ukraine Yulia Tymoshenko stressed this instrument is significant for Ukraine as it concerns the most vulnerable branch – energy sector. According to the PM, this branch necessitates huge investments. The Head of Government underlined signing of the document would enable broadening cooperation in the issues of reforming of energy and introduction of energy saving programs.

IMF and World Bank praise activity of Ukraine’s government

Representatives of the international financial institutions hail success of the Government in activity directed to resuming of trust into the banking system of Ukraine. Director of the World Bank for Belarus, Ukraine and Moldova Martin Raiser announced during a joint media conference with participation of the Prime Minister of Ukraine Yulia Tymoshenko and IMF Resident Representative in Ukraine Max Alier on Wednesday, government portal reported.

Martin Raiser added owing to the efforts of the Government of Ukraine in this direction deposits from the banking system have ceased flowing out and the process of accumulation started.

Furthermore, as he put it, a decision of the Government concerning recapitalization of the three banks (Ukrgazbank, Rodovid Bank and Bank Kyiv) “is a crucial step that is to facilitate to prolong the program with success and also to resume and strengthen trust into the banking system of Ukraine”.

To his part, IMF Resident Representative in Ukraine Max Alier, on commenting the decision of the Government on recapitalization of the banks, underlined: “It is very significant as the depositors can feel confidence in the future. It is significant either as the process applied to achieve such results demonstrates the Government who has made this significant step is protecting interests of tax payers”.
