In a letter to the Crimean Premier, governors, and mayors of Kyiv and Sevastopol, Victor Yushchenko wrote that the cabinet continued to perform its duties and was absolutely legitimate until parliamentary elections, President’s press office informed.

The President substantiated his refusal to accept a recent voting to sack the government and said he had already prepared an appeal to the Constitutional Court to recognize this resolution as illegal. However, he noted that his appeal “cannot be considered, for the Verkhovna Rada has blocked the Constitutional Court.”

President Yushchenko opened Cabinet meeting

Opening a special cabinet meeting, Victor Yushchenko said he expected the government to present a clear program for the first quarter of 2006, presidential press office reported.

The President pointed out that he had two reasons to convene the meeting. First of all, the ministers should analyze the situation in the executive system and, second, they should formulate “an absolutely clear-cut program for their efficient work” until the new cabinet is formed after elections. Their priority is to start introducing energy saving reforms. 

Addressing those present, the Head of State said in such circumstances they could demonstrate their professional commitment and patriotism.

Commenting on a recent voting to sack the cabinet, Yushchenko claimed that he withdrew from the Memorandum on Cooperation, signed in September 2005 between government and opposition. The President said he did it “because the other side has neglected its fundamental principle of cooperation to stabilize the situation in Ukraine.”

Yushchenko added that all recent events proved the suppositions that unbalanced changes to the Constitution might undermine the situation.    

He opined that the Constitutional Court “is, in fact, the first victim of the victory of corporate interests over country’s needs.”

“We can say that the Constitution of Ukraine is deprived of its voice,” he stressed.

The President, however, expressed confidence that because of the current situation the government would find many “normal democratic” partners.

He also insisted on the importance to build constructive relations with the Verkhovna Rada.

“I hope that regardless of what has happened after that resolution the government will consider building constructive relations with parliament to be one of its priorities,” he said.

Yushchenko thinks during this session they should approve about thirty important bills “which can lay fundamentals of new policy in 2006.”

“So I would like to ask the government and parliament to reach a sufficient level of communication and understanding to pass these laws,” he noted.

The President also pledged to observe the law, “We must show all political forces that we respect the Constitution of Ukraine and will act legally.”

“Andrey Shkilhas nothing in common with the Ukrainian National Assembly-Ukrainian National Defense Party (UNA-UNSO), as he left it when he became a member of Batkivshchina (Homeland) Party. For UNA-UNSO Shkil is like a finger cut off, and that’s all. Andrey Shkil will do what Yulia Timoshenko tells him to do,” leader of the UNA Party Yuri Shukhevich said at a news conference in Lvov on January 12, reports Regnum.

“Interests of Mistress Yulia are closer for Shkil and higher than the interests of Ukraine. Probably, it can be proved by the party discipline and so on. But as for Timoshenko herself, she is more concerned with her personal ambitions, than with the fate of Ukraine,” noted Shukhevich. According to him, Bloc of Yulia Timoshenko (BYT) has started losing voters’ sympathy long before the elections. “Today common members of BYT switch to UNA-UNSO in dozens,” Shukhevich noted.

As for reasons of BYT losing support of the electorate, Shukhevich listed among them voting against the state budget and for the for the dissmissal of the government. “Such voting is a trivial treason,” concluded the UNA-UNSO leader.

President of Ukraine urges parliament to rescind Cabinet’s dismissal (updated)

Victor Yushchenko insisted that the Verkhovna Rada should revoke its Resolution on the Dismissal of the Prime Minister and Members of the Cabinet, passed on January 10, 2006, as unconstitutional.

“By no means objecting to the constitutional right of parliament to dismiss the government, I still find it important to point out that this right can only be exercised in accordance with the Constitution of Ukraine,” he wrote in a letter to parliament.

The President said only two reasons to exercise such a right were stipulated by the Constitution. According to Article 87, the President or 150 parliamentarians can submit a relevant proposal to the Verkhovna Rada which can then pass a no-confidence motion to dismiss the government. He reiterated that no such proposals had been submitted.   

According to Item 12 of Part 1 of Article 85, the Verkhovna Rada can comply with Premier’s request to resign.

“There was not such a request by the Prime Minister,” Yushchenko stressed.

He said according to Article 152 legal acts were considered unconstitutional when parliamentarians failed to observe all procedures of their approval.

The President prepared an appeal to the Constitutional Court of Ukraine to recognize the Resolution of the Verkhovna Rada of Ukraine on the Dismissal of the Prime Minister and Members of the Cabinet as illegal.

The Head of State stressed that “the court cannot consider the appeal, for the Verkhovna Rada has blocked its work” and added that in this situation he could only ask the Verkhovna Rada to revoke its resolution.

President liquidated the disproportion of pensions for the military pensioners, acting as Defence Minister Hrytsenko told.

“The colonel retired five years ago will not get pension which is less than praporshik’s one retired a year ago,” said Hrytsenko.

Coming out in the special session of the government, Victor Yushchenko announced that withdrew his signature under the Memorandum signed together with the leader of Party of Regions Victor Yanukovich.

He motivated his decision by the fact that the Party of the Regions violated its obligations stated in the Memorandum by voting for the dismissal of the Cabinet.

The immunity of the local authorities must be seized

Our Ukraine faction intends on urgent consideration of the drafts initiated by President and the Cabinet of Ministers touching upon limitation of the maximal size of officials’ salaries and immunity of the local councils’ members.

According to Serhiy Zhyzhko the member o the faction, the proposals were not included in the plenary agenda although the members of the parliament agreed to consider the items.

The immunity prevented 441out of 514 local officials from criminal responsibility they deserved, Zhyzhko told.
