New facts in “Kolesnikov’s case”

Andrey Fedur, the advocate of the head of Donetsk regional council Boris Kolesnikov, is sure as before that his client is kept in jail illegally.

On today’s press-conference Fedur declared about some new fact, about which he came to know not from the investigative group. In particular, Kolesnikov never bought share stocks from the citizen Boris Penchuk, who is "a victim" in this case, and who is the initiator of the "Kolesnikov’s case" according to the investigation. Fedur added that Penchuk is still one of the biggest stockholders of Trade Center "Beliy Lebed" (he owns 10%).

Fedur pointed out that Kolesnikov bought stocks of Vladimir Penchuk (father of Boris Penchuk) and his wife. Kolesnikov also purchased stock from other stockholders, and none of them complained.

Besides, Fedur underlined that Kolesnikov did not buy stocks personally, but gave commissions to a company, specialized in stock trade, to draw up all the documents.

The advocate also reported that Kolesnikov possessed the stocks only for a few months and then sold them due to absence of Investment Income.

Yatsenuk advices Ukrainians “not to touch dollars”

The former acting head of National Bank of Ukraine, the present first deputy head of Odessa regional state administration, Arceny Yatsenuk, declares that he "not quite share the present policy of National Bank" regarding dollar.

In his point of view, hryvnia revaluation can cause shortfall of budget by 2%. Yatsenuk negatively regards of governmental attempts to influence the policy of NBU. According to him, the former government wanted hryvnia devaluation, the present one – revaluation. But in fact, Yatsenuk admitted, the government should not interfere into National Bank affairs at all.

In response to the question what Ukrainians should do with their savings, Yatsenuk advised "not to flounce". "People should calm down and do not touch dollar savings. Money does not like fuss," added Yatsenuk.

Officials to legalize prostitution

Mikhail Andtrienko, the head of Department of struggle against human traffic, speaks in support of legalization of prostitution, DVC reported.

As he said, this is a usual practice for many European countries. In these countries prostitutes pay taxes to the state budget. For example, highest taxes earnings in Istanbul’s budget are received from brothels.

According to unofficial information, traffic in illicit sex-business in Kiev was now worth some 5.5 million USD a month.

"I think we must legalize it", – Andrienko said.

An intergovernmental search is called for Shcherban

Ministry of Internal Affairs of Ukraine in accordance with the decision of the Office of Public Prosecutor of Sumskaya region called an intergovernmental search for the former head of Sumy regional state administration, Vladimir Shcherban.

Zarechny local court of the Sumy city gave its consent to arrest V.Shcherban and to deliver him to Ukraine.

As the Department of public contacts reported to ForUm, a criminal action was brought against Shcherban according to the article 189, part 2 and the article 365, part 1 of Criminal Code of Ukraine.

The ex- governor of Sumy is accused of extortion of assignation or right to property using his official position, with a threat of murder, which caused property damage, and of abuse of power or official position. Commitment of these crimes provides for custody for the period from 2 to 7 years with deprivation of the right to hold some certain posts or to carry on some certain kind of activity for the period to 3 years.

Bodelan’s congratulations – respect or mockery

The former mayor of Odessa Ruslan Bodelan, for whom an international search was called, congratulated the citizens of Odessa with the 60th anniversary of the victory in WWII by a telegram.

This congratulation was spread by the press-service of the city organization of Party of Regions, which is headed by Bodelan.

This telegram is treated ambiguously. The supporters of the ex-mayor are sure that Bodelan has demonstrated his respect to the city. From the other side, many citizens consider it as a mockery at law machinery.

We remind, Ministry of Internal Affairs of Ukraine in accordance with the decision of the Office of Public Prosecutor of Odessa called an international search for the former city chairman of Odessa Ruslan Bodelan.

The U.S. will review “List-301” regarding Ukraine

The U.S. will review “List-301” regarding Ukraine

The U.S. is planning a pre-term evaluation of sanction withdrawal – measures which were introduced due to the inadequate protection of intellectual property rights in the country.  This fact was reported by the U.S. Embassy in Ukraine.  According to the Embassy report, the U.S. commercial representation declared that a pre-term analysis of the "List-301" program regarding Ukraine will take place in 2005. 

"List-301" (from article 301 of the Commercial Act of the U.S.) is a list of countries, which, according to the U.S., inadequately protect intellectual property rights.  A review of the list takes place every April, however, according to the Embassy report, a pre-term analysis can be carried out at any time in response to changes that may take place.  The U.S. intends to investigate the amendments in the legislation of Ukraine as regards the optical information carriers (laser discs). 

The U.S. also intends to observe the control of pirating of the optical information carriers via the appropriate laws.  "The U.S. Embassy positively regards the recent efforts on the part of the Verkhovna Rada to initiate legislative amendments, which would eliminate the faults of the current laws concerning the licensing of optical discs," commented John Hurbst, the U.S. Ambassador to Ukraine. 

According to the Ambassador, a pre-term evaluation of "List-301" can be considered progress in this regard, without having to wait until April of 2006.  At the same time, Hurbst emphasized that while the amendments to the law are not approved, there are no preventative measures in effect to protect from illegal manufacture and distribution of optical discs. 

In April 2001, the U.S. rid Ukraine of a favorable status, which allows the country to enjoy commercial advantages in trade with the U.S.  In addition, in January of 2002, the U.S. imposed sanctions in the amount of $75 million on imports from Ukraine. 

As was reported by ForUm on April 29, the U.S. has continued the imposition of sanctions due to the inadequate protection of intellectual property rights.  Ukraine is the only country in the "Priority" group (those that are in need of special monitoring due to breaches).  This year there are fifty-two countries on the U.S. "List-301," which includes EU (as a single country).

Students of BSFA, who went on hunger-strike, were hospitalized

In the Chernovtsy city six students of Bukovinsky State Finance Academy (BSFA), who went on hunger-strike and demanded the resignation of the head of their academy, Vladimir Pryadko, were hospitalized on the ninth day of the hunger-strike in connection with sharp worsening of health.

At the same time more than 20 students of the same academy, supported by students of Chernovitsky National University and Bukovinsky Medical University, continue the protest action in a tent town, which was placed near BFSA on April 25.

Deputies’ faction of "Nasha Ukraina" (Our Ukraine) in Chernovtsy city council sent a letter to the minister of finance of Ukraine, Victor Pinzenik, with a demand to solve the conflict immediately. According to deputies of city council, the cause of the mass protest action was "persecution of students for supporting Victor Yushchenko during presidential election."

Students of BSFA accuse the rector Pryadko of "authoritarian style of guidance", agitation for Victor Yanukovich during presidential elections, prohibition to be on strike during "orange revolution", coercive exactions in the academy and pressure on active workers of civil campaign "Pora".

Commission of Verkhovna Rada of Ukraine invites Bilozir and Baloga for interrogation

The member of Commission of VR of Ukraine, Mikhail Dobkin reported that the minister of culture and tourism, Oxana Bilozir, and the chairman of Transcarpathian regional state administration, Victor Baloga, are invited for interrogation to the temporal investigative commission charged with violation of human rights and liberties.

According to Dobkin the commission session will take place on May 10 in connection with investigation of the fact of mass dismissions for political motives.

As Dobkib declared, "in the course of investigation of mass dismissions of citizens in connection with their political views, the numerous facts, argumentative of acts of psychological pressure and lustration against dissidents, became known."

"I have statements of people, dismissed for being a member of SDPU (u) (Social Democratic Party of Ukraine (united) – ed.), or for not supporting Yushchenko during presidential elections," said the deputy.

"Having examined the facts, our commission decided to interrogate the people involved in illegal oppression of citizens. In this case we have some questions exactly to Bilozir and Baloga," added Dobkin.
